British Columbia Men Convicted of Cruelty for Starving Horse Prior to Hanging

Two men in Victoria, British Columbia, were convicted of cruelty for starving a horse prior to killing it by hanging it from a backhoe.

The men, David Whiffin and Clayton Cunningham, had been warned by the BC SPCA to get veterinary care for the 27 year old horse which was in extremely emaciated condition.  The men then "euthanized" the animal by tying it to the backhoe and hanging it.

CTVBC.CTV.CA reported that the SPCA was not pleased with the judge's decision to convict the men only for the starvation.   The judge found that there was not enough evidence to show that the horse had suffered cruelty prior to its death.

A SPCA cruelty investigator told CTVBC:

"This is what we feel is a huge loophole in the Criminal Code, because any reasonable person would recognize that tying a horse with ropes to a backhoe and lifting it off the ground is certainly not a humane way to kill an animal."
