Irish Olympic Equestrian Team Selection: Lynch's Appeal Dismissed by CAS
The Court of Arbitration for Sport has published its decision regarding Denis Lynch's appeal to be reinstated to the Irish Olympic Show Jumping Team. The decision, published on the CAS website is as follows:
London, 29 July 2012 – The ad hoc Division of the Court of Arbitration for Sport (CAS) has dismissed the application filed by the Irish horse rider Denis Lynch who requested to compete for Ireland in the individual equestrian show jumping event at the 2012 London Olympics.
A CAS Panel composed of Mr Alan Sullivan (Australia), President, Mr Sharad Rao (Kenya) and Mr Stuart McInnes (UK) held a hearing last night from 8pm to 1am. Denis Lynch, his counsel, and representatives for Horse Sport Ireland (HSI), the Olympic Council of Ireland (OCI), the IOC, the FEI and for Cian O’Connor attended the hearing.
The CAS Panel ruled that it lacked jurisdiction to deal with the application of Denis Lynch considering that:
1) the decision of the OCI/HSI Monitoring Group of 10 July 2012 to consider Denis Lynch as ineligible for selection for the 2012 Olympic Games was not subject to appeal before the CAS, and
2) the dispute did not arise during the period of jurisdiction of the CAS ad hoc Division, which started on 17 July 2012.
