On April 22, 2011, Jessica Kürten, in the presence of veterinarians and lawyers for both parties, returned five top show jumping horses to the custody of Lady Forbes.

 

Lady Forbes posted a bond of €300,000 as required by the Court in Dusseldorf where their legal dispute was heard.

 

The dispute apparently was triggered by legislation in Germany regarding taxes on prize money; Ms. Kürten and Lady Forbes did not agree regarding responsibility for paying the tax.

 

Lady Forbes' attorney issued the following press statement (Horseweb.de):

 

1. Under the arrangement approved by the Düsseldorf Higher Regional Court
(Oberlandesgericht Düsseldorf) on 6 April 2011, Ms Jessica Kürten, her husband
Eckart Kürten and Sporthorses International Ltd. had the obligation of returning
Ms Forbes’ horses to her immediately upon provision of a small security (to cover
alleged claims).
2. Mr and Ms Kürten and Sporthorses International Ltd. at first refused to fulfill the
obligations established in the Düsseldorf Higher Regional Court and only agreed to
return the horses on 20 April 2011 after being threatened with compulsory
enforcement measures.
3. The rightful state of affairs has finally been reestablished. The court will now decide
on the claims put forward by Mr and Mrs Kürten and Sporthorses
International Ltd―for which absolutely no proof has been presented to date―without
having to deal with the unlawful retention of the horses.
