David Owen, a construction maintenance engineer, was seriously injured in an automobile accident in 2008 caused by loose horses on the A46 in Evesham, near Worcester.
The horse owner, Amanda Johnson, pleaded guilty to charges of allowing her animals to be loose.
During the accident, Owen broke his neck in several places and underwent surgery in 2010.
Horse and Hound reports that Owen said:
"The police told me it was the ninth recorded incident of horses being on the road in this area."
The suit maintains that Mrs. Johnson was negligent in securing and repairing her fencing.
No date has been set for the trial.
